Evidence Review in a DUI Case
A DUI charge isn’t the same as a conviction. We examine how law enforcement gathered, documented, and preserved the evidence rather than relying solely on the arrest report. This review can reveal factual disputes, testing issues, or inconsistencies that affect the prosecution’s allegations.
Our attorneys can visit the arrest location and investigate the arresting officer’s background. We can also examine breathalyzer testing and arrange for blood samples to be reanalyzed when appropriate. If testimony must be challenged at a hearing or trial, we can subpoena and cross-examine officers about their observations and procedures.
Our experience as Deputy District Attorneys gives us direct knowledge of how the prosecution may assess a DUI case. We take on fewer matters so we can devote substantial attention and resources to the facts, legal issues, and available defense strategy in each case.
The DMV Deadline After a Goleta DUI Charge
After a California DUI arrest, a driver generally has 10 calendar days from the arrest date to request a DMV Administrative Per Se hearing. This administrative hearing allows the driver to contest the California Department of Motor Vehicles action against their driving privileges. We can request and attend the hearing on a client’s behalf.
For a first alleged offense involving a blood alcohol concentration of 0.08% or higher, failing to request the hearing generally allows the administrative suspension to begin on day 31. That suspension is typically four months, although the applicable action depends on the facts and the driver’s record.
The DMV Administrative Per Se process is separate from the criminal case. A result in one proceeding doesn’t determine the result in the other, so both require timely attention. The short DMV request period is one reason to speak with our attorneys promptly.
Criminal DUI Proceedings in Santa Barbara County
DUI cases arising in Santa Barbara County are handled through the Santa Barbara County Superior Court. The Criminal Division requires matters to be placed on the court calendar before the hearing date and doesn’t allow walk-in arraignments. The specific location and schedule depend on the court’s assignment of the case.
Arraignment & Plea
The arraignment is the formal court appearance at which the charge is presented and a plea is entered. After a not-guilty plea, the matter moves into pretrial proceedings, allowing time for evidence review, supported motions, and negotiations with the prosecution.
Pretrial Review & Negotiation
During the pretrial stage, we analyze reports, test evidence, officer testimony, and other available materials. Our established relationships within Santa Barbara’s legal community inform how we communicate and negotiate, while every recommendation remains grounded in the circumstances of the individual case.
Trial
If no resolution is reached, the case can proceed to trial. We can challenge the prosecution’s evidence through cross-examination, evidentiary objections, and a defense supported by the record. The allegations, available evidence, and client’s objectives guide whether negotiation or trial is the appropriate course.
