What are the Penalties For Robbery in California?

In California, there are two types of robbery: first degree and second degree. In order to be convicted of robbery of the first degree, the robbery needs to either take place in an inhabited dwelling or structure, involve a bus, taxi, or other type of public transportation driver, or occur when an individual is using an ATM. First degree robbery is punishable by a prison sentence between three and nine years and a fine of up to $10,000.

Second degree robbery is considered any robbery which doesn’t meet the definition of first degree robbery. Second degree robbery is punishable by a prison sentence between two and five years and a fine of up to ten thousand dollars.

Sentence enhancements include the following:

  • Cause another person to suffer a “great bodily injury”
  • Use of a gun during the commission of the robbery
  • Had a previous robbery conviction
